Empowering Employer Child and Elder Care Solutions Act
Official title: To amend the Fair Labor Standards Act of 1938 to exclude child and dependent care services and payments from the rate used to compute overtime compensation.
This bill excludes the value of employer-funded child or dependent care from being used in calculating an eligible employee's overtime pay.
Under current law, overtime hours must be paid at one and a half times an employee's regular rate of pay. This rate is an average hourly rate that must include certain types of pay, such as commissions. The bill specifies that an employer can provide or pay for child or dependent care services without the value of the services being included in this calculation.

For the purpose of debate only, I yield the customary 30 minutes to the gentlewoman from New Mexico (Ms. Leger Fernandez), pending which I yield myself such time as I may consume. During consideration of this resolution, all time yielded is for the purpose of debate only.
I rise today in strong support of the Empowering Employer Child and Elder Care Solutions Act, a bipartisan proposal that meets working families where they are and strengthens our economy at the same time.
I rise today to address an issue affecting both families and businesses in Indiana and across the United States, which is the expensive, but essential, financial support workers need to provide care for their young children and elderly parents.
America is suffering. Americans don't recognize the country we live in. Trump's tariffs have caused prices to soar. We have the highest unemployment rate in 4 years so fewer people have jobs. Those out of work can't even afford those expensive groceries, housing, and appliances.
I rise in opposition to H.R. 2270, the Empowering Employer Child and Elder Care Solutions Act. Unfortunately, it doesn't solve anything. It doesn't provide any additional child or elder care.
Republicans are doing everything in their power to undermine investments in childcare, including with this bill, which will allow employers to exclude childcare benefits from overtime pay.
